Welcome to Moochi. These Terms of Service (“Terms”) govern your use of our website and purchases from our online store.

Please read these Terms alongside our Privacy Policy, Refund & Returns Policy, and any shipping information provided before checkout.

3. Orders & Payments

3.1 Placing an Order

Placing an order is an offer to purchase products under the terms displayed at checkout.

An automated order confirmation acknowledges receipt of your order. We accept your order when we send a dispatch confirmation, unless we expressly confirm acceptance earlier.

Before acceptance, we may decline an order for a reasonable reason, including:

• Unavailable stock

• A genuine product or pricing error

• Suspected fraud or unauthorised payment

• Missing information needed to fulfil the order

• A delivery address outside our service area

• A technical or payment-processing failure

We will notify you where an order cannot be fulfilled. If payment has been collected for a cancelled order, we will refund the affected amount to your original payment method.

Unless clearly stated otherwise, Australian store prices are in Australian dollars (AUD).

Displayed consumer prices include applicable GST where required. Shipping charges and the final order total are shown before you complete payment.

Prices and offers may change for future purchases. Changes do not alter an accepted order without your agreement.

If we identify a pricing error before accepting an order, we will explain the issue and give you the option to proceed at the corrected price or receive a refund.

3.3 Payments & Additional Offers

Payment must be authorised through an available checkout payment method.

Purchases are one-time purchases unless you separately and expressly agree to a subscription. Optional add-ons and post-purchase offers require your acceptance and an additional payment.

4. Product Information

We aim to provide accurate product descriptions, images, dimensions, prices, and availability information.

Please note:

• Stated dimensions may be approximate where identified as such

• Minor cosmetic or packaging variations may occur without changing the product’s essential characteristics

These variations do not permit us to supply a materially different product from the one described or ordered.

Moochi squishies are toys intended for appropriate play and tactile enjoyment. Individual preferences and experiences vary. They are not medical treatments, and website information is not individual medical advice.

5. Product Use & Care

Follow the age recommendations, warnings, and care instructions supplied with each product.

• Keep products away from babies and children below the recommended age

• Supervise children as directed by the product instructions

• Do not bite, swallow, cut, puncture, or heat squishies

• Keep them away from sharp objects and excessive heat

• Avoid excessive force or stretching beyond the product’s intended use

• Stop using a product if it tears, leaks, or develops loose parts

Damage caused by misuse may not qualify for a remedy where the misuse caused the problem. This does not exclude rights relating to manufacturing defects or other failures covered by Australian Consumer Law.

6. Shipping & Delivery

Shipping charges and estimated processing and delivery times are provided on our website or at checkout.

Delivery estimates may be affected by carrier delays, weather, holidays, high order volumes, and remote delivery locations. We will help investigate delays and provide updates where available.

Please provide a complete and accurate delivery address. Contact us promptly if you notice an error; changes may not be possible once fulfilment has begun.

If an order requires resending because you supplied an incorrect address, we will explain any reasonable additional shipping charge and obtain your agreement before resending it.

If your parcel is delayed, missing, damaged, or marked delivered but cannot be located, email buymoochi@gmail.com. We will investigate with the relevant provider and arrange an appropriate resolution.

Nothing in this section removes our responsibility to supply your order or provide remedies required by law.

7. Returns & Refunds

Our Refund & Returns Policy explains the return process.

In general:

• Change-of-mind return requests must be made within 14 days of delivery

• Change-of-mind items must be unused, unopened, and in their original packaging

• Opened or used squishies are excluded from change-of-mind returns

• Different conditions apply to faulty, damaged, incorrect, or misdescribed products

Your statutory rights are not restricted by the change-of-mind return window or packaging requirements.

8. Promotions, Bundles & Free Items

We may offer discounts, bundles, buy one, get one free promotions, seasonal sales, and other offers.

The conditions displayed when you purchase apply to your order. Unless an offer states otherwise:

• Offers are subject to the stated eligibility conditions and available promotional stock

• Free items are included only where shown as part of the offer

• Customers must select the required quantities and variants through the offer selector

• Promotional items have no separate cash redemption value

• Discount codes cannot be combined unless expressly permitted

• New promotions do not apply retrospectively to completed orders

• Offers end on the stated date or when the specified promotional allocation is exhausted

Buy One, Get One Free

Where offered, select both your paid and free Moochi using the offer selector. Available colours and combinations are shown when ordering.

Shipping charges may still apply unless the offer expressly includes free shipping.

For a full change-of-mind refund, all items in the promotional pair must be returned in accordance with our Refund & Returns Policy. Contact us about any proposed partial return so we can explain the available options and refund amount.

These conditions do not restrict remedies for faulty or otherwise non-compliant products.

9. Reviews & User Content

If you submit a review, photograph, video, or other content, you confirm that you have the necessary rights and permissions to share it.

Content submitted as a review or testimonial must reflect your actual experience.

You must not submit content that:

• Is knowingly false or misleading

• Infringes another person’s intellectual property or privacy

• Is unlawful, abusive, defamatory, or harmful

Where you separately permit promotional use, we may reproduce or adapt your content within the scope of that permission. We will not change its meaning or present it misleadingly.

15. Australian Consumer Rights

Our goods come with guarantees that cannot be excluded under Australian Consumer Law.

For a major product failure, you are entitled to choose a refund or replacement. Other failures must be remedied as required by law. You may also be entitled to compensation for reasonably foreseeable loss or damage.

These rights apply to eligible promotional and sale purchases as well as full-price purchases.

If mandatory consumer law conflicts with these Terms, that law prevails.
